1. Mandatory Arbitration
Arbitration clauses may limit your ability to bring disputes in court and often prohibit class actions. If dispute resolution terms are one-sided, treat this as a significant legal risk.
2. Broad Liability Disclaimers
Many terms include sweeping warranty disclaimers and liability caps. Watch for language that shifts nearly all operational risk to the user, especially for payment and data loss scenarios.
3. Unilateral Policy Changes
If a provider can change terms at any time without meaningful notice, your risk profile can shift after you sign up. Prefer policies with clear notification timelines and change logs.
4. Account Suspension Without Recourse
Terms that allow immediate suspension or termination "for any reason" can create continuity risk. Look for appeal paths, notice requirements, and data export options.
5. IP and Content License Scope
Review what rights you grant over submitted content. Risk increases when licenses are perpetual, worldwide, sublicensable, and not limited to service operation.
